Sandbar Trading Auction Terms and Conditions 2020

Bidders are Bound by The Terms and Conditions of this Sale set forth here and they are the complete and only terms and conditions on which all property is offered for sale. By registering and/or bidding on the iCollector Website or with Sandbar Trading the buyer agrees to be bound by these Conditions of Sale.

We will be offering Viewing of the Auction items in our Gallery September 24, 25, 26, October 1, 2, 3, October 8, 9, 10, and on October 15, 16 and 17 during normal business hours. Our Gallery is located at 414 South Commerce in Wichita, Kansas 67202 USA.
Gallery hours are Thursday through Saturday 11:00 am - 4:00 pm, CST
All buyers are urged to physically inspect the item during the inspection period. No bids can be withdrawn after the auction for any reason. No items can be returned for any reason.

BUYER'S PREMIUM for this Auction is 20% up to $3000, 17% for $3000-10,000 and 15% for $10,001+, this will be added to the final winning bid.

We reserve the right to withdraw any Auction Item at any time before the auction and shall have no liability whatsoever for such withdrawal. Offerings in this Auction are subject to errors or omissions in descriptions. The on-line catalog may be amended up to 2 hours before the Auction begins and the entire agreement with any and all Purchasers of the property listed herein.

Timed auctions do not have an auctioneer calling the bids – Our bidding window opens for this Auction on Wednesday September 30, 2020 at 9 AM CST and goes through Sunday October 18, 2020 at 2 PM CST. We will have an extension of 3-minutes for any bid coming in within the last 1-minute of the item closing, allowing all bidders a fair chance to bid on the item that they desire. The high bid when the item closes wins the item. Each lot can be bid on for a defined time period anytime during the period of the Auction. At the end of this period, the bidder who has submitted the highest bid wins the lot, provided the bid is at or exceeds the starting price.

As a Service to our Customers that are on record as doing business with our Gallery, Sandbar Trading, we are Happy to make bids on their behalf. To reduce the chance of error, the Gallery requests the Client make bidding arrangements 24 hours or more before the auction begins. The Customer must be a Registered Bidder with Sandbar Trading. When Customers provide us a Bid, we will execute these bids “as if” we were at a Live Auction. That is, we will put in the lowest bid that wins the item and will continue to bid until another bidder goes over your Maximum Bid. We shall not be responsible for any errors or omissions or failure to execute such absentee bids, or if your High Bid is the same as another Bidder but they placed that Bid 1st, we are not liable. Bidding will be open for the period shown, so there is time for you to bid. Please place your bids early. We also reserve the right to decline to undertake any such bids. Bids should be made in U.S. dollars on the Bid Sheet.

Purchase Price
The purchase price paid by the winning bidder is the aggregate of the final price, which is the final price received on the item plus a Buyer’s Premium plus any, shipping, handling and payment processing including applicable Kansas State Tax and the City of Wichita, Kansas Taxes for Kansas Residents.
Buyers must pay the full Purchase Price for each purchased lot within 14 days after the date of the auction. Accepted payments are cash and personal check at the Gallery with Customers that we have a business relationship and by Visa, Mastercard, American Express, and Discover when registering on the iCollector Platform. Unless exempt by law, the Purchaser will be required to pay any and all applicable Kansas state taxes. In the event of deliveries outside of Kansas, it is the Purchasers responsibility to pay any compensating or use tax of another state on the purchase price. All monies shall be made payable to Sandbar Trading or iCollector. At Our discretion, payment will not be deemed to be complete until funds represented by checks or credit cards have been cleared and fully processed by the Sellers bank, usually within 1-10 days. A $50 (fifty dollar) service fee will be charged to a Buyer that writes a check that does not clear for payment. We reserve the right to hold shipment until payments clear the bank. Items shall not pass to Buyer until all invoices are paid in full

Dealers will need to have a copy of their valid resale license emailed, hand delivered or mailed to Sandbar Trading no later than 48-hours prior to the Auction. If not received by the Auction Date we will have to charge applicable taxes on all purchases for this Auction.

Dispute Between Bidders: If any dispute arises, the decision of Rick @ Sandbar Trading shall be final and absolute to the resolution of the dispute.

iCollector bids are executed with and against outside, competing, and absentee bids. If any dispute arises after the sale, Sandbar Trading sales records shall be conclusive in every respect.

All Lots are being Sold AS IS:
Neither Sandbar Trading, iCollector, Consignors or Anyone associated with this Auction make any express or implied warranties or representations with respect to the property or correctness of the advertisement, catalog, lot descriptions and any other medium used to announce this auction or any other description of the physical condition, dating, attribution, provenance, genuineness, description, condition of the property, estimate of value, quality, importance, size or authenticity of the property offered and described either online or via telephone, text, email or any other communication.

By placing a bid, either on iCollector, by phone, leaving a bid at Sandbar Trading Gallery or any other method, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. Merchandise returns will not be accepted for any reason.

Please Carefully Read the information provided on each lot. Notwithstanding any condition reports or catalog descriptions provided, all lots are offered and sold AS IS. In most cases, we describe to the best of our knowledge the quality, and other information of the item.
Dimensions are given in inches. Unless noted all items have some amount of acceptable wear, scratches, nicks, missing stitches, etc. for their age.
Measurements on paintings and pictures are image size, paintings and pictures that are in frames have not been examined outside the frame.
Bracelets measurements are opening, inside circumference, height. Weights are in Grams and are weighed to the best of our ability. The term signed means that, in our opinion, the signature is by the artist. All dating, Turquoise and hallmark attributions are to the best of our knowledge. Attributions are subjective and should be taken as such. Attributions in the description of any lot is left to the buyer to determine accuracy and the gallery is not responsible for any errors or omissions.

Estimates of Value:
We provide an estimate of an items value, as a service to Bidders. These estimates are based on being a retail gallery for 19 years, participating in numerous Shows annually and following items that we handle on numerous Auction Sites. We provide a Low and High Estimate on each item. It should be noted that our High Estimate is what similar items might sell in the Marketplace and not necessarily the Retail Price in our Gallery in Wichita, Kansas.

No Reserve Auction: The Starting price is the lowest price that any item will sell at, there is no reserve above the starting price.

Neither the Gallery, Auctioneer nor any Consignor make any representations whatsoever that the Purchaser of a work of art will acquire any reproduction rights thereto and copyright to work. Purchasers ownership of the work shall remain subject to the copyrights of the artist and Gallery.

We will require a Credit Card be on file for Bidding at this Auction. A list of valid major credit cards is available when registering. You can register on the icollector Platform or in our Gallery during normal business hours.

All successful bidders will be sent a “copy invoice” for inspection as soon as possible after the Auction. We will then bill the Credit Card on File, or you will be billed thru iCollector for items purchased on their platform and where you registered. The Price Billed per lot is the final bid price + premium + shipping and taxes for those living in the State of Kansas.

We offer in house shipping. Please provide a correct street address, email address and telephone number for our shipper in order to expedite the receipt of your purchase. We combine shipping on multiple lots when possible and you will only be billed for the actual cost of the combined shipping and handling. On most items we offer Flat Rate Shipping using UPS Ground, or United States Postal Service on items shipping into the lower 48 States of USA. Check the Lot Description for that items shipping cost.
On all items the Shipping Address will be the Same as the address that you provide as your credit card address.
Shipping costs to Alaska, Hawaii and foreign countries will be quoted individually. Buyers are responsible for all taxes, customs fees and VAT that may apply to their purchase and shipment. All US shipments are shipped signature required. Shipment generally occurs within ten business days after payment has been received but may take up to 21 days.

Any items not paid for in 14-days after the invoice has been sent will be considered “not sold” and the item will stay with Sandbar Trading to sell in the Gallery, on our Website, at Shows or in a Future Auction. If for any reason a purchased lot cannot be delivered in the same condition as at the time of sell, or should any purchased lot be stolen, mis-delivered or lost prior to delivery, Sandbar Trading shall not be liable for any amount in excess of the final price paid by the purchaser.

Pickup at the Gallery, located at 414 South Commerce Street is available by appointment beginning October 22, 2020 and continuing during regular business hours for three weeks. By appointment we can meet with a Buyer at the Gallery for pickup at other times. Buyers may make their own arrangements for shipping by contacting the gallery or arrange pick-up at the Gallery by their designated shipping agent. If using an agent, buyer must contact the gallery for a pick up release form and one will be emailed for electronic signature. Sandbar Trading will not release any lot to a buyer’s agent without payment in full, clearance of payment, and signed release form. Sandbar Trading is not responsible for insurance, custom fees, VAT taxes damage or loss by a Buyer’s Agent or Shipper.

Limitation of Rights. Any right of the purchaser under this agreement or under the law shall not be assignable and shall be enforceable only by the original purchaser and not by any subsequent owner or any person who shall subsequently acquire any interest. No purchaser shall be entitled to any remedy, relief or damages beyond return of the property, rescission of the sale and refund of the purchase price; and without limitation, no purchaser shall be entitled to damages of any kind.

Any Claim must be made within 3 days of receiving your item(s) all packing material and boxes must be present for shipping company to inspect! Claims cannot be settled until shipping company has completed their investigation and ruled on their findings.

In order to prevent inaccuracy in delivery or inconvenience in the settlement of a purchase, no lot can be transferred to another buyer. Each buyer must pay for the whole of his purchases before any lot can be removed from the premises.

Bidder expressly releases the Gallery, Auctioneer, its officers, directors and employees, its affiliates, and its outside experts that provide second opinions, from any and all claims.
