Shipping Details:
Shipping will be estimated cost. If the cost is extremely higher, we will contact buyer. We pack and ship small items, US Coins, Jewelry, smalls, Firearms... All furniture and large bulk items, buy must arrange for 3rd party shipping. Local pickup is always available.
Payment Details:
Payments are expected within 2 days of auction. Only good current credit cards are accepted. We will invoice you after auction and add estimated shipping. All oversize furniture will be bidders responsiblilty to arrange for 3rd party shipping. We will pack and ship small items, coins, jewelry and firearms. Be aware of shipping costs if you are bidding on furniture items or large glassware lots.

TERMS OF SALE
Upon acceptance of the final bid by the auctioneer, buyer accepts these terms of sale:
1. All sales are by lot number listed in the catalog. If the quantity listed for a lot number is greater than “1”, then the amount bid is by the quantity (qty) listed. For example: the Qty column lists “2” and the successful bid is $ 10, then the total bid price is 2 x $10= $20. We reserved the right to add lots for sale at the time of the auction, to sell lots out of order, and to group two or more lots for sale. No lots will be broken.
2. The auctioneer shall regulate the bidding. We reserve the right to reject any bid not believed by us to be in good faith. In the event of a dispute concerning a bid, the decision of the auctioneer is final. The auctioneer may re-offer and re-sell during the auction any lot in dispute.
3. Payment may be made only by cash, cashier’s check, personal check ( if buyer is known to us), American Express, Discover, Master Charge, or Visa. All sales are final at the fall of the auctioneer’s gavel. We retain title to all property until we have received payment in full. Buyer shall pay for all purchases in full on the day of the auction and remove the merchandise. Any purchases that have a returned check or non valid credit card will be charged a $45 fee. All online bidders must have valid credit card and be paid in full within 3 days of auction.
4. The Auctioneer and/or Past and Present Collectibles assumes no responsibility for errors in the catalog or online descriptions, advertising or on the part of any bidder.
5. Shipping is the responsibility of the Buyer. The Buyer must pay for all charges incurred for small items and firearms. Any large items must be arranged by the buyer for Freight shipments. Shipping insurance is the responsibility of the buyer.
6. In addition to the hammer price of each item, 12% buyers premium is charged onsite. 15% Buyers Premium online. All sales and use tax and all license and transfer fees are additional.
7. All property is offered for sale “AS IS.” We do not warrant the fitness for purpose, merchantability or condition of any property offered for sale. All Bidders must establish to their own satisfaction the authenticity and condition, before bidding. ALL SALES ARE FINAL, NO REFUNDS, NO EXCEPTIONS! Buyer assumes the risk of breakage after the fall of the auctioneer’s gavel. All expressions of grade, condition and authenticity are only our opinions, and no warranty or guaranty is made.
8. All FIREARMS ARE SOLD AS COLLECTIBLE ITEMS ONLY. They are not intended to be used without having them checked by a GUNSMITH. WE EXPRESSLEY DISCLAIM ANY WARRANTY CONCERNING THE CONDITION, FUNCTIONING OR SAFETY OR ANY FIREARM OFFERED FOR SALE.
9. Any firearm that is post 1898 must be registered according to the Federal and California Law. Buyers must complete all Firearms paperwork on Auction day. Firearms registration will be typed into computer within 2-3 working days. It will be the buyers own responsibility to call and confirm that your firearms are ready for pickup, prior to coming in. Call: 619-579-9140. We will do our best to have Firearms ready for pickup on the Saturday, apx 2 weeks after the auction, depending on when your form was entered into the computer. Out of State and Online bidders will have to have make arrangements with Past and Present Collectibles to have their items shipped. A valid FFL dealer license needs to be faxed to Past and Present Collectibles, immediately after the auction. We will pack and ship, UPS. They buyer is responsible for the shipping charges.
10. Consignors are not allowed to bid on their own merchandise, or to have anyone bid on their behalf. If the Auctioneer recognizes such bidding or is advised of it, the auctioneer may withdraw any or all lots and the consignor will be charged accordingly.
11. All items offered are for sale in the Auction Only. There will be no pre or post SALES of the items.
12. ANY person approaching our customers and trying to sell their own merchandise privately, will be asked to leave the auction house. We value the privacy of our customers and do not want them being used by “shady” sellers that have their own purpose in mind. It is a danger for customers to make side deals or give out their own private information, address or phone number to a stranger.
13. BIDDERS MUST SIGN IN TO OBTAIN AN BIDDER CARD, UPON SIGNATURE, BUYER IS AGREEING TO THE TERMS OF SALE.
14. In the event of a dispute related in any manner to the auction or property purchased, buyer agrees with us to submit the dispute to final and binding arbitration in the City of El Cajon, San Diego County, California. No party shall be entitled to attorneys’ fees or costs. Our liability shall be limited to the total of the bid price, buyer’s premium, sales or use tax and, if applicable, license or transfer fees.
